other rules (collectively the "T&C") posted on the Honeyami Website,
www.honeyami.com, (the “Site”) constitute an agreement between HONEYAMI
LLC ("Honeyami", “we", "our", "us") and you, the visitor, governing your
access and use of all content and functionalities available at the Site.
By accessing the Site, you warrant and represent to Honeyami that you are
legally entitled to do so and to make use of information made available via the
website, and accept and consent to the practices described in the T&C.
Those persons wishing to use our services must read and agree to be bound by
our policies relating to those services. In particular, we draw your attention
to our policies relating to the terms of purchase and our Privacy Policy. If you
are under the age of 18, you must let your parent or guardian know about Honeyami’s Privacy Policy before you register to use this Site or any of this Site's
services.
You may download or copy the content and other downloadable materials
displayed on the Site for your personal use only. No right, title or interest in
any downloaded content is transferred to you as a result of any such downloading

unregistered trademarks of the Honeyami. Nothing contained on this website
should be construed as granting any license or right to use any trademark
without the prior written permission of the Honeyami.
Errors or Omissions
Occasionally there may be information on the
Site that contains typographical errors, inaccuracies, or omissions that may
relate to product descriptions, pricing, promotions, offers, and availability.
We reserve the right to correct any errors, inaccuracies or omissions and to
change or update information or cancel orders if any information on the Site is
inaccurate at any time without prior notice (including after you have submitted
your order).
Applicable laws
Use of the Site shall in all respects be
governed by the laws of the state of New York, regardless of the laws that might
be applicable under principles of conflicts of law. Subject to the satisfaction
of the terms and conditions contained in the Section of this T&C entitled
“Dispute Resolution”, all actions or proceedings relating, directly or
indirectly, to use of the Site shall be resolved solely in courts located within
the City, State and County of New York and you consent and agree to submit to
the exclusive jurisdiction of these courts.
Disclaimer
The materials on the Site are provided "as is" without
warranties of any kind, either express or implied, including without limitation,
warranties of title, implied warranties of merchantability, fitness for a
particular purpose or non-infringement of intellectual property. Honeyami
expressly disclaims any duty to update or revise the materials on the Site,
although Honeyami may modify the materials at any time without notice. Your
use of the Site is at your sole risk, and you assume full responsibility for any
costs associated with your use of the Site. Honeyami shall not be liable for
any damages of any kind related to your use of the Site.
Indemnification
You agree that you will not use this Site for any
unlawful purpose, or for any purpose prohibited by these Terms of Use. You agree
to defend, indemnify and hold Honeyami, its members, employees, agents,
affiliates and principals harmless from and against any and all claims, damages,
costs and expenses, including attorneys' fees, arising from or related to your
use of the Site and/or your breach of any representation, warranty, or other
provision of the T&C.
Dispute Resolution
Mindful of the high cost of litigation, not
only in dollars but also in time and energy, both you and Honeyami agree to
the following dispute resolution procedure: In the event of any controversy,
claim, action or dispute arising out of or related to any transaction conducted
on the Site, or the breach, enforcement, interpretation, or validity of the
T&C ("Dispute"), the party asserting the Dispute shall first try in good
faith to settle such Dispute by providing written notice to the other party (by
first class or registered mail) describing the facts and circumstances
(including any relevant documentation) of the Dispute and allowing the receiving
party 30 days in which to respond to or settle the Dispute. Notice shall be sent
(1) to Honeyami LLC. at: Honeyami LLC, 321 West 55th Street, #54, NY, NY 10019 or (2) to you at: your last-used billing address or the
billing and/or shipping address in your online profile. Both you and Honeyami
agree that this dispute resolution procedure is a condition precedent which must
be satisfied prior to initiating any litigation or filing any claim against the
other party.
Non-Waiver
Honeyami’s failure to insist upon strict enforcement
of any provision of this agreement shall not be construed as a waiver of any
provision or right thereunder.
TRANSACTIONS
Placing Your Order
You may place your order online through honeyami.com. All credit and debit card transactions are secure. All online
orders are encrypted and sent through a secure server, using SSL technology to
prevent information being intercepted. To order merchandise on honeyami.com,
simply click on your chosen item, select the desired color and size, and add it
to your shopping bag. You may then continue shopping or, once you have added all
the items that you wish to purchase to your shopping bag, begin the checkout
process which involves verifying your order, shipping information, billing
information and placing your order.
We reserve the right to refuse any order you place with us. We may, in our
sole discretion, limit or cancel quantities purchased per person, per household
or per order. These restrictions may include orders placed by or under the same
customer account, the same credit card, and/or orders that use the same billing
and/or shipping address. In the event we make a change to or cancel an order, we
will attempt to notify you by contacting the e-mail and/or billing address/phone
number provided at the time the order was made. We reserve the right to limit or
prohibit orders that, in our sole judgment, appear to be placed by dealers,
resellers or distributors.
Product Availability
All orders are subject to acceptance and
availability. We work with our manufacturing facilities to maintain appropriate
stock levels within each season to ensure we are able to satisfy your needs.
From time to time we may run out of a particular style, color or size and we
make our best attempt to accurately reflect current stock availability on the
Site. If you have any questions regarding the availability status of a
particular style, color or size, please email us at info@honeyami.com.
Product Representation
We have made every effort to display as
accurately as possible the colors of our products that appear on the Site. We
cannot guarantee that your computer monitor's display of any color will be
accurate.
Changes to Your Order
You can send changes to orders@honeyami.com. Changes can only be
made if your request is answered before your order is processed. Once your order
is processed or shipped, no changes can be made.
Payment Methods
We currently accept the following payment
methods, Visa, MasterCard, and Discover. If you get
an error message after submitting your credit card information, please double
check to make sure that you entered the following correctly.
- Your name as it appears on the card;
- Billing address;
- Credit or debit card number; and
- Credit card expiration date.
Note: Unfortunately, we cannot accept cash, checks, money orders, traveler’s
checks, ATM or shared value cards.
Sales Tax
Honeyami charges tax on orders shipped in New York, based on local sales tax rates.
Order Acceptance
You will receive an email acknowledging the
details of your order once it has been placed. This email is NOT an acceptance
of your order.
Unless you cancel your order, acceptance of your order by Honeyami will be
finalized upon completion of the packing of your order. Completion of the
contract between you and Honeyami will be finalized when we ship the product
to you. At that time you will receive a second email containing you tracking
number, and confirming that your order has been shipped.
We reserve the right to not accept your order in the event, for example, that
we are unable to obtain authorization for payment, that shipping restrictions
apply to a particular item, that the item ordered is out of stock and is not
scheduled for replenishment.
RETURN & EXCHANGE POLICY
Returns Policy
We understand that you may wish to return your
item. Your item must be unworn, unused and in the original packaging. You must
make sure that we receive the returned item within 14 days of you first
receiving your parcel. Please note that any items returned outside of the
returns policy will not be accepted. We do not cover the cost of shipping for
returned parcels.

Refund Policy
All returns requiring a refund must be authorized
by Honeyami. Refunds will be issued in the original form of payment less any
applicable shipping charges. Original shipping fees are non-refundable. For
refunds on damaged items, please include a receipt of the shipping charges with
your return. The processing of your refund may take approximately 30 days.
Exchange Policy
If an exchange on an item is necessary for a
different style, size or color we would be glad to issue a refund, but would
request that you purchase the desired item through our Site as a separate
transaction. For guidance on making a return please see the return policy.
DMCA COMPLIANCE
If you believe any content on the Site infringes your copyright, you should
immediately send a notice of any such potential infringement to Honeyami’s
Copyright Agent. Your notice must meet the requirements of the Digital
Millennium Copyright Act (as required under 17 U.S.C. §512) by providing the
following information:
- An identification of the copyrighted work claimed to have been infringed;
- An identification of the material that you claim is infringing so that we
may locate it on the site;
- Your address, telephone number and email address ;
- A statement by you that you have a good-faith belief that the disputed use
is not authorized by the copyright owner, its agent or the law;
- A statement by you that the above information in your notice is accurate,
made under penalty of perjury, and that you are authorized to act on behalf of
the owner of the copyright interest involved; and
- Your signature.
